Busy Holiday Weekend for FCSO: Intoxicated Driver Arrested for Hitting a Bicyclist and Suspect Tries Hiding from Deputies in a Hot Attic

Over the long Labor Day Weekend, between 6 a.m. on Friday, August 30th, and 6 a.m. on Tuesday, September 3rd, local law enforcement agencies arrested a total of 28 people, including 8 for DUI, and made 13 boating stops with zero BUIs. The Flagler County Sheriff’s Office (FCSO) handled 1,237 calls for service and made 258 traffic stops.

Woman Riding Her Bike Hit by a DUI Driver

 

The Flagler County Sheriff’s Office assisted the Florida Highway Patrol in an arrest on Sunday, September 1, 2024. A victim was riding her bike at the intersection of Fellowship Dr. and Palm Harbor Parkway, around 6:30 p.m. when she was hit by a vehicle. Deputies arrived at the scene and found the woman with serious injuries. She was flown by Life Flight to Halifax Health.

FHP took over the investigation and determined, Scott Niehaus, 57, of Palm Coast was driving under the influence and was arrested. He was transported to the Sheriff Perry Hall Inmate Detention Facility.

“Here we have another preventable situation where families’ lives were affected by a bad decision. This man chose to get behind the wheel while intoxicated,” said Sheriff Rick Staly. “Just days ago, the Flagler County Sheriff’s Office and other agencies across the state reminded Floridians about the operation, ‘Drive Sober, Get Pulled Over.’ We will not tolerate drunk driving.”

Palm Coast Man Arrested After Trying to Hide from Deputies in the Attic

On Friday afternoon, Michael Allison, 37, of Palm Coast thought he could hide from FCSO in his attic. He was wanted on a felony violation of probation warrant for Unlawful Possession of a Controlled Substance and Driving with a Suspended License. Deputies saw him enter a home on Piedmont Drive. Deputies knocked on the door and windows announcing themselves to Allison and why they were at the home. After several attempts, deputies entered the home to search for Allison. It was determined he was hiding in the attic. Deputies contacted Allison and 30 minutes later he came down on his own, but extremely dehydrated. He was treated at a hospital and then taken to the Sheriff Perry Hall Inmate Detention Facility.

“This guy decided to try and hide in the attic, during a Florida summer. If you’re a criminal in Flagler County, there’s nowhere to hide from the Flagler County Sheriff’s Office,” said Sheriff Rick Staly. “I hope he enjoyed his attic sauna but now he’s in the Green Roof Inn.  I commend our deputies for talking him out of a hot attic peacefully before he hurt himself in the heat.”

Labor Day Weekend Movie Disrupted due to a Domestic Disturbance Leading to an Arrest

On Sunday, September 1, 2024, moviegoers’ summer blockbuster at Epic Theater on Central Avenue was interrupted by a couple in a fight. Ashley Nenna, 33, of Ormond Beach was watching a movie with the victim when she accused him of looking at other women in the theater. Nenna slapped the victim twice, causing his glasses to hit the floor and causing a commotion in the theater. The Flagler County Sheriff’s Office was called to the theater and deputies found Nenna in the theater hallway. Deputies noticed the smell of alcohol while trying to speak with Nenna, who initially refused to identify herself. She then started yelling at deputies and had to be escorted outside. Nenna was uncooperative and started pulling away from deputies, so she was detained while deputies spoke with the victim. The victim, who will not be named due to Marcy’s Law, admitted to being slapped in the theater. Nenna was arrested for Domestic Battery, Disorderly Intoxication in a Public Place, and Obstruction Without Violence.

“Instead of leaving the theater to have an adult conversation, Nenna decided to resort to violence inside a cinema where others were trying to enjoy a movie,” said Sheriff Rick Staly. “At no point in a relationship should anyone decide to attack a significant other in their life or interrupt others just trying to enjoy a holiday watching a movie. Now she knows what it’s like to visit the Green Roof Inn because of her antics!”
